Prohibited on All Plans
The following uses are never permitted, including on paid annual plans
- Upload as standalone music to Spotify, Apple Music, SoundCloud, or any DSP
- Broadcast TV, theatrical film, broadcast radio, or large studio games
- Register with ASCAP, BMI, SESAC, or any rights organization
- Resell on stock music sites (AudioJungle, Pond5, Artlist, etc.)
- Use real artist names or copyrighted lyrics as prompts
- Train competing AI models with Generated Content
1. Overview
This Music License Agreement ("License") governs the rights granted to you for music, audio, and related content generated through the CreateYourMusic.ai platform ("Generated Content"). By using the Platform, you agree to the terms outlined below.
The scope of your license depends on your subscription plan at the time the content is generated. Please review the plan-specific terms carefully before using any Generated Content in your projects.
CreateYourMusic.ai uses third-party AI models to generate music. Your license rights are subject to and limited by the terms imposed by these upstream model providers. We cannot grant rights that exceed what our model providers authorize.
2. Free Plan: Personal Use Only
Users on the Free plan are granted a non-exclusive, non-transferable, revocable license to use Generated Content for personal, non-commercial purposes only.
Permitted uses:
- Listening for personal enjoyment
- Sharing on personal social media accounts (without monetization)
- Personal projects, demos, or student work (non-commercial)
NOT permitted on the Free plan:
- Any form of monetization (monetized YouTube, ads, paid products)
- Any commercial project, product, or service
- Any broadcast, film, or media production
If you need commercial rights, please upgrade to a paid annual plan.
3. Paid Monthly Plans: Personal Use Only
Paid monthly plan users (Starter, Hobby, or Professional monthly) receive the same personal use license as Free plan users. Monthly plans do NOT include a commercial license.
Monthly plans provide access to premium AI models, higher credit allocations, and faster generation, but the usage rights for Generated Content remain non-commercial.
To unlock commercial rights, upgrade to an annual plan.
4. Paid Annual Plans: Commercial License
Users on a paid annual subscription plan (Starter, Hobby, or Professional annual) are granted a non-exclusive, worldwide, perpetual license to use Generated Content for both personal and commercial purposes, subject to the restrictions in Sections 5 and 6.
The commercial license applies to all content generated while your annual subscription is active. Once generated under a valid annual plan, the license for that specific piece of content remains valid permanently, even if you later cancel or downgrade.
Permitted commercial uses:
- Monetized YouTube videos, Twitch streams, and online content
- Podcasts (including ad-supported and premium/paid podcasts)
- Indie games, mobile apps, and interactive media
- Online advertisements, promotional videos, and brand content
- Presentations, webinars, e-learning, and corporate training
- Background music for events, venues, and retail spaces
- Social media content (TikTok, Instagram Reels, etc.) including monetized
5. Prohibited Uses: All Plans
Regardless of your subscription plan, the following uses are strictly prohibited. Violation may result in immediate license revocation and account termination without refund.
Distribution on music streaming platforms:
- You may NOT upload, distribute, or release Generated Content as standalone music on Spotify, Apple Music, Amazon Music, SoundCloud, Pandora, Tidal, Deezer, or any similar digital streaming platform (DSP).
- This restriction applies to all plans, including annual commercial licenses.
- Generated Content may only be used as part of a larger work (e.g., background music in a video), not as a standalone music release.
Film, television, and broadcast radio:
- Generated Content may NOT be used in broadcast television, theatrical films, broadcast radio, or large studio game productions without a separate written agreement from CreateYourMusic.ai.
- This restriction does not apply to online-only content such as YouTube videos, web series, or podcasts.
Stock music and resale:
- You may NOT resell, sublicense, or redistribute Generated Content as standalone audio files.
- You may NOT upload Generated Content to stock music marketplaces (e.g., AudioJungle, Pond5, Epidemic Sound, Artlist).
- You may NOT create a music library or catalog of Generated Content for licensing or distribution to third parties.
Copyright and rights organization registration:
- You may NOT register Generated Content with any performing rights organization (ASCAP, BMI, SESAC, PRS, GEMA, JASRAC, or equivalent) or claim songwriter/composer credits for AI-generated portions.
- You may NOT register Generated Content with the U.S. Copyright Office or any equivalent authority as a human-original composition.
- AI-generated content does not currently qualify for copyright protection in most jurisdictions.
Content creation restrictions:
- You may NOT submit real artist names, band names, or songwriter names as generation prompts (e.g., "in the style of [real artist]").
- You may NOT submit substantial portions of existing copyrighted song lyrics as input prompts.
- You may NOT use Generated Content to create deepfakes, impersonations, or misleading content that implies involvement of real artists.
Other prohibited uses:
- Using Generated Content to train, fine-tune, or develop competing AI music generation models.
- Using Generated Content for content that is illegal, harmful, threatening, defamatory, or infringes on the rights of others.
- Using Generated Content in a way that implies endorsement by CreateYourMusic.ai, its model providers, or any third party.
- Removing or altering any metadata or watermarks embedded in Generated Content.
6. Important Limitations
No exclusivity guarantee: Because Generated Content is created by AI models, other users submitting similar prompts may receive similar or identical output. We do not and cannot guarantee that your Generated Content is unique or exclusive to you.
No copyright ownership: Generated Content is produced by AI. Under current law in most jurisdictions, purely AI-generated content may not qualify for copyright protection. CreateYourMusic.ai does not claim copyright ownership over your Generated Content, but neither can we guarantee that you will be able to enforce copyright claims over it.
Input ownership: You retain full ownership of any original input you provide (original lyrics, custom prompts, melodies) that you created independently before submitting to the Platform. The AI-generated output based on your input is licensed to you, not assigned or transferred.
Model provider terms: Generated Content is subject to the terms and conditions of our upstream AI model providers. If a model provider modifies their terms in a way that restricts previously permitted uses, we will notify affected users and update this License accordingly. We will not retroactively revoke rights for content already generated under previous terms.
Platform availability: We do not guarantee uninterrupted access to the Platform. Downtime, model changes, or service discontinuation do not affect licenses already granted for previously generated content.
7. Attribution
For paid plan users, attribution is not required but is appreciated. If you choose to credit the Platform, you may use: "Music created with CreateYourMusic.ai".
For Free plan users, we strongly encourage (but do not require) attribution when sharing Generated Content publicly.
8. License Verification
Each piece of Generated Content is associated with your account, timestamped, and linked to your subscription tier at the time of generation. This record serves as your proof of license.
If you need to verify your commercial license for a specific piece of content (for example, in response to a platform content claim, a client request, or for business compliance), contact us at support@createyourmusic.ai with your account email and the content in question. We will provide written confirmation of your license status.
9. Disputes and Refunds
If you believe your Generated Content has been incorrectly flagged or claimed by a third party, contact us at support@createyourmusic.ai. We will assist you in resolving the dispute by providing license verification.
Subscription fees cover access to the Platform and its AI generation capabilities. Fees are non-refundable except as described in our Refund Policy. License disputes do not independently entitle you to a refund.
If you are dissatisfied with the quality of Generated Content, please review our Refund Policy at createyourmusic.ai/refund-policy for eligibility.
10. Termination and Revocation
We reserve the right to revoke your license and terminate your account if you violate this agreement or the Platform's Terms of Service. Grounds for revocation include, but are not limited to:
- Distributing Generated Content on prohibited platforms (e.g., Spotify, Apple Music)
- Registering Generated Content with rights organizations
- Using real artist names or copyrighted lyrics in prompts
- Any use that violates the prohibited uses listed in Section 5
Upon revocation, you must immediately cease all use of Generated Content associated with your account. License revocation does not entitle you to a refund.
For content generated under a valid commercial license before revocation: if the revocation is due to a violation unrelated to that specific content, the commercial license for previously generated content remains valid. If the revocation is due to misuse of that specific content, all rights to that content are terminated.
11. Changes to This Agreement
We may update this License from time to time to reflect changes in our services, model provider terms, or applicable law. Changes will be posted on this page with an updated "Last updated" date.
Material changes that reduce your existing rights will be communicated via email to registered users at least 30 days before taking effect. Such changes will not apply retroactively to content already generated under previous terms.
Continued use of the Platform after the effective date of changes constitutes acceptance of the revised License. If you do not agree to the revised terms, you may stop using the Platform. Your existing licenses for previously generated content remain valid.
